1. About This Document

These Terms of Use govern your access to and use of the website located at www.asianschoolofcyberlaws.com (the "Website"), including all courses, tools, and content available through it. Please read these Terms carefully before using the Website. If you do not agree to these Terms, you must not use the Website.

These Terms are a legally binding agreement between you ("User", "you") and Alcertis Education Ventures Private Limited ("Company", "we", "us", "our"). By accessing the Website, registering for a course, or using the vDPO tool, you agree to be bound by these Terms.

2. Who We Are

The Website is operated under the brand name Asian School of Cyber Laws.

3. Acceptance of Terms

By accessing or using any part of the Website, you confirm that:

  • You are at least 18 years of age, or if you are below 18 years, you have obtained the consent of a parent or legal guardian;
  • You have the legal capacity to enter into a binding agreement;
  • You have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are accessing the Website on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

4. Use of the Website

You may access and use the Website for lawful purposes only and in accordance with these Terms. You agree to use the Website solely for your personal, non-commercial educational purposes, unless you have entered into a separate written agreement with us for commercial use.

You must not:

  • Use the Website in any manner that violates any applicable law or regulation, including the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023;
  • Attempt to gain unauthorised access to any part of the Website, server, or database connected to the Website;
  • Introduce any virus, trojan, worm, or other malicious or technologically harmful material;
  • Use any automated means, including bots, scrapers, or crawlers, to access or collect content from the Website;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

5. Course Enrolment and Access

The Website offers the following programmes:

  • Certificate in Data Protection Law — a foundational online course;
  • Certified Data Protection Officer (CDPO) — an advanced professional programme that includes access to the vDPO tool.

Upon successful enrolment and receipt of full payment, you will be granted a personal, non-transferable, non-exclusive licence to access the course content and, where applicable, the vDPO tool, for the duration of access specified at the time of enrolment.

Course access is granted to the individual who enrols. You may not share your login credentials, allow any other person to access your account, or distribute course content in any form. Any such sharing constitutes a material breach of these Terms and may result in immediate termination of your access without refund.

We reserve the right to update, modify, or withdraw any course content or features at any time. We will use reasonable efforts to notify enrolled students of material changes.

Important: Completion of any course on this Website does not constitute legal advice and does not create any professional or fiduciary relationship between you and Alcertis Education Ventures Private Limited or its faculty. Nothing in any course is to be construed as legal advice applicable to your specific situation.

6. The vDPO Tool

Access to the vDPO compliance platform ("the Tool") is included as part of the Certified Data Protection Officer (CDPO) programme. The Tool is provided solely for educational and professional development purposes.

Your data and ours. When you use the Tool, you may enter data relating to organisations, processing activities, vendors, data flows, and other compliance information ("Tool Data"). You retain ownership of Tool Data that you enter. By entering Tool Data into the Tool, you grant us a limited licence to store and process that data solely for the purpose of providing the Tool's functionality to you.

You acknowledge that in respect of Tool Data that relates to other identifiable individuals or organisations, you are the Data Fiduciary for that data and we act as a Data Processor on your behalf. You are responsible for ensuring that your use of the Tool complies with applicable data protection law, including the Digital Personal Data Protection Act, 2023.

You must not enter into the Tool any personal data that you are not lawfully authorised to process. We are not responsible for any unlawful or unauthorised processing of personal data carried out through the Tool by you.

The Tool is provided on a best-efforts basis. We do not warrant that the Tool will be error-free, uninterrupted, or that the compliance outputs generated by the Tool are legally sufficient for your specific circumstances. The Tool is an educational aid — it is not a substitute for legal advice.

7. Fees, Payments, and Refunds

Fees. Course fees are as displayed on the Website at the time of enrolment and are exclusive of Goods and Services Tax (GST) unless otherwise stated. GST is applicable at the prevailing rate. A GST invoice will be provided upon request.

Payment. Payments are processed through Razorpay. Where a student is unable to complete payment through Razorpay, we may accept payment by UPI transfer to our registered UPI ID. All payments must be made in full prior to course access being granted.

Early bird pricing. Where an early bird fee is offered, it is valid only until the date specified on the Website. Enrolment at the early bird price is subject to availability and may be withdrawn at any time before the specified closing date.

Refund policy. You may request a full refund within 7 calendar days of the date of payment, provided that your request is submitted before course access commences. Refund requests received after course access has commenced will not be entertained.

All approved refunds will be processed as follows:

  • The course fee paid (inclusive of GST) will be refunded, subject to the deductions below;
  • A deduction will be made for payment gateway charges, being approximately 2% of the transaction value charged by Razorpay, which are non-recoverable by us;
  • An administrative charge of 10% of the course fee (exclusive of GST) will be deducted to cover processing, onboarding, and administrative costs incurred at the time of enrolment;
  • Refunds will be credited to the original payment source within 7–10 business days of approval.

To request a refund, write to info@asianschoolofcyberlaws.com with your name, enrolment details, and transaction reference.

No refunds will be issued after course access has commenced, for partial completion of a course, or for change of mind after the 7-day window.

8. Intellectual Property

All content on the Website — including but not limited to course materials, video lessons, text, graphics, the vDPO tool, its interface, its underlying framework, logos, and trade marks — is the exclusive property of Alcertis Education Ventures Private Limited or its licensors and is protected by applicable intellectual property laws.

Your enrolment grants you a personal, non-transferable licence to access and use course content for your own personal educational purposes only. You may not:

  • Copy, reproduce, republish, upload, post, transmit, or distribute any course content;
  • Sell, rent, sub-licence, or otherwise commercially exploit any course content;
  • Remove or alter any intellectual property notices on course content;
  • Use any content from this Website to create competing educational materials or products.

Any feedback, suggestions, or ideas you provide to us regarding the Website or its products may be used by us without any obligation to you.

9. User Accounts

To access course content and the vDPO tool, you will be required to create an account on the Website. You are responsible for:

  • Maintaining the confidentiality of your login credentials;
  • All activity that occurs under your account;
  • Ensuring that your account information is accurate and kept up to date.

You must notify us immediately at info@asianschoolofcyberlaws.com if you become aware of any unauthorised use of your account or any security breach.

We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms or engaged in any fraudulent or harmful conduct.

10. Prohibited Conduct

In addition to the restrictions set out elsewhere in these Terms, you must not:

  • Share, resell, or redistribute course access credentials or course materials;
  • Record, screen-capture, or otherwise copy course videos or live sessions without our prior written consent;
  • Use the Website or its content to defame, harass, or harm any person;
  • Post or transmit any content that is unlawful, offensive, or infringes the rights of any third party;
  • Attempt to reverse-engineer, decompile, or disassemble the vDPO tool or any part of the Website's technology;
  • Use the Website or any data obtained from it for any purpose that violates applicable law.

11. Third-Party Services

The Website uses the following third-party services:

  • Razorpay — payment processing. Transactions are subject to Razorpay's own terms and privacy policy;
  • SMTP to Go — email delivery for transactional and marketing communications;
  • DreamHost — website hosting services;
  • Google Analytics — website analytics (or similar analytics tools that may be deployed). These tools may use cookies and similar tracking technologies as described in our Privacy Policy.

We are not responsible for the terms, privacy practices, or conduct of any third-party service provider. Links to third-party websites, if any, are provided for convenience only and do not constitute our endorsement of those websites.

12. Disclaimers

The Website and all content, courses, and tools are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The Website will be uninterrupted, secure, or error-free;
  • Any course content is complete, accurate, current, or sufficient for any specific compliance or legal purpose;
  • Completion of any course will guarantee employment, career advancement, or qualification for any regulatory role;
  • The vDPO tool's outputs will constitute legally sufficient compliance documentation in any jurisdiction.

Data privacy law is a rapidly evolving field. While we make reasonable efforts to keep course content current, we do not guarantee that all content reflects the most recent legislative or regulatory developments at the time you access it.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Alcertis Education Ventures Private Limited, its directors, officers, employees, and faculty shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Website, courses, or the vDPO tool;
  • Any loss of data, revenue, profits, or goodwill;
  • Any regulatory action, penalty, or legal liability you incur in connection with your use of course content or the vDPO tool;
  • Any loss arising from reliance on course content as legal advice.

In no event shall our total aggregate liability to you for all claims arising out of or relating to your use of the Website exceed the total amount of fees paid by you to us in the 12 months preceding the event giving rise to the claim.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts at Pune, Maharashtra, India.

Before initiating any formal proceedings, you agree to notify us in writing of the dispute and allow us 30 days to attempt to resolve it informally.

15. Amendments

We reserve the right to amend these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where reasonably practicable, notify enrolled students by email.

Your continued use of the Website following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Website.
